Subject Matter of these General Terms and Conditions of Sale

1. These General Terms and Conditions of Sale (“General Terms”) govern the terms and conditions of sale between MF Design, owner of the website https://mfj-design.com (the “Website”), and any individual who intends to purchase the handcrafted and made-to-order products offered by MF Design S.r.l., whether by registering on the Website (the “Customer”) or without registration, through either the public or restricted-access sections of the Website (the “Products”), solely for personal and non-professional use.

2. These General Terms apply to retail sales of Products to consumers via the internet, governed by Italian Legislative Decree no. 206/2005 (“Consumer Code”) and Legislative Decree no. 70/2003.
3. Seller: MF Design S.r.l., Tax Code and VAT no. 01232360253, registered office in Sedico (BL), Zona Industriale Gresal, 14.
Customer: a consumer who is at least 18 years old and resides in a country where online sales through the Website are enabled.
4. MF Design S.r.l. ships Products worldwide, except to countries subject to embargo or other restrictions. Furthermore, Product availability may vary depending on the country from which the Website is accessed or the destination country.
5. These General Terms may be amended at any time. The applicable version is the one published at the time of contract conclusion. MF Design S.r.l. shall not be bound by any terms proposed by the Customer that differ from or conflict with these Terms. Prices, Products, and their features may be subject to change without notice.
6. Acceptance of these General Terms by the Customer is a necessary condition for completing the purchase procedure.
Contract Execution
1. To make a purchase, the Customer may register on the Website and access the reserved area using personal login credentials, or proceed without registration, selecting a Product to purchase and adding it to the designated “Cart” section. The Product details, price in Euro, applicable VAT, and estimated delivery time will be displayed. MF Design S.r.l. bears the sole cost of worldwide shipping. Registration, Website access, and use of the e-commerce service are entirely free of charge; the Customer is solely responsible for costs related to internet access and necessary equipment.
2. The order is placed upon completion of the Product’s production by MF Design S.r.l., by entering shipping and payment details into the designated payment section, as required by the payment service provider. These details may be modified until the “Purchase” button is clicked. By placing the order, the Customer expressly agrees to be contacted by MF Design S.r.l. via email, phone, or at the indicated address for all communications related to the conclusion and execution of the contract.
3. Payment may be made by:
o Credit card (Visa, Mastercard, American Express) via the secure Stripe platform. Charges are processed according to the terms of the issuing provider.
o Apple Pay and Google Pay, for compatible devices and browsers, also via Stripe. Payment is immediate and does not require card data entry.
o Pay by >link, through a secure payment link sent via email or SMS. The charge is immediate at the time of payment.
o Advance bank transfer, payable to:
o MF Design S.r.l., IBAN: IT 37 J 08904 11900 011000004770
o SWIFT: CCRTIT2TPRE, Bank: Banca Prealpi San Biagio
o Reference: Order number and customer name.
The order will only be processed upon receipt of the payment, which must occur within 5 working days for SEPA transfers or 8 working days for non-EU transfers. Otherwise, the order will be automatically cancelled.
4. MF Design S.r.l. will send the Customer an order confirmation email, including the sales terms, delivery timeline, and the order specifications (e.g., color and size). The Customer’s order and the applicable General Terms are electronically archived by MF Design S.r.l.
5. The sales contract is deemed concluded when MF Design S.r.l. receives payment from the Customer. The order is processed upon receipt of full payment.
6. Contract validity is subject to the successful creation of the Product. If the required materials are unavailable, MF Design S.r.l. will notify the Customer within 20 days of receiving the order and reserves the right to cancel the contract, refunding the full purchase price without additional costs or liabilities.
Production and Delivery Times
1. All jewelry sold through this Website is handcrafted to order and personalized based on the specifications provided by the customer at the time of purchase (color, size, etc.).
2. MF Design S.r.l. shall deliver the Product to the Customer within the timeframe indicated on the Website and confirmed in the order confirmation, at the delivery address specified by the Customer.
3. Shipping is free worldwide, and this is clearly stated both on the Website and in the order confirmation. For shipments outside the European Union, any customs duties, local taxes, import charges, or other levies shall be borne exclusively by the Customer. These costs, if applicable, are not included in the Product price.
4. Shipping and delivery will be carried out as specified in the order confirmation. If not otherwise specified, delivery will occur within forty (40) business days from the day the Customer places the order and completes payment. Delivery times may vary depending on the destination, force majeure, or events not attributable to MF Design, including customs delays in destination countries.
5. The Product will be delivered to the address indicated by the Customer, who is obliged to accept delivery and facilitate the process as specified in the order. In the case of an unjustified refusal to accept delivery, MF Design S.r.l. reserves the right to terminate the contract, without prejudice to its right to compensation for damages (including shipping and storage costs). If the Customer refuses to pay customs duties or import taxes and the Product is returned to the sender, any costs incurred for shipping and return will be deducted.
6. Upon delivery, the Customer must verify the integrity, quantity, and type of the Products received: that they match the order, and that the packaging is intact and undamaged, making any complaints to the courier immediately on the delivery slip in case of defects or discrepancies.
7. Delays due to the customized production process shall not be valid grounds for contract termination, except as provided by applicable law.
Quality
The quality of the Products and their storage and shipping procedures are designed to ensure long-lasting preservation. Products may differ slightly from the photos on the Website https://mfj-design.com, which is a sign of their artisanal and artistic uniqueness.
MF Design S.r.l. declares that all catalog products are manufactured and marketed in compliance with applicable technical standards and good manufacturing practices.
Each Product on the Website includes a detailed Technical Sheet outlining its features, materials, technical specifications, and care instructions.
Price
1. The final Price includes VAT, shipping costs, and any fees associated with the chosen payment method. Customs duties are not included.
2. The Customer must pay MF Design S.r.l. using the methods available on the Website. Delivery will only occur after full payment is received within the timeframes specified in the order confirmation.
Customer Obligations
The Customer must ensure the accuracy of the data provided during the contract process and promptly notify MF Design S.r.l. of any changes by appropriate written communication.
Warranty and Limitation of Liability
1. The Customer must report any lack of conformity to MF Design S.r.l. by registered letter with return receipt within two months from discovery. MF Design S.r.l. is liable for defects occurring within two years of delivery. Claims must be brought within 24 months from the delivery date, unless defects were fraudulently concealed.
2. The warranty is valid only if the Products are used in accordance with their instructions and upon presentation of the delivery documentation and order number. Except where required by law, MF Design S.r.l. offers no additional warranties or conformity declarations beyond what is expressly stated on the Website.
Right of Withdrawal
1. Under Articles 52 et seq. of the Consumer Code, Customers who qualify as consumers may withdraw from the contract without penalty and without providing a reason within 14 (fourteen) days of Product delivery.
2. This right may be exercised through the Website’s dedicated procedure or by using the appropriate withdrawal form available online.
3. Products must be returned to MF Design S.r.l. in their original condition, including all parts, accessories, documentation, and original packaging, which should be kept as intact as possible. MF Design S.r.l. may reject returns of damaged or used Products or those lacking any required elements.
4. Return shipping costs are the sole responsibility of the Customer and will be communicated in advance. The Customer is also responsible for the integrity of the Products until they are returned.
5. MF Design S.r.l. will refund the Product price, less return costs, within 14 (fourteen) days of receipt using the same payment method used by the Customer, as provided by Article 56 of the Consumer Code.
6. Unless otherwise agreed, the Customer may not exercise the right of withdrawal in the following cases: – supply of customized or made-to-measure goods or goods that by their nature cannot be returned; and in other cases, provided by law, especially Article 59 of the Consumer Code. The right of withdrawal is also excluded if the Product has been handled beyond what is necessary to determine its nature, characteristics, and functioning.
Communications
For contractual purposes, written communication includes any digital communication that allows durable storage (e.g., emails, HTML pages).
Contract Storage
1. The contract and related order documents are stored by MF Design S.r.l. at its registered office for purposes necessary to perform the contract and comply with legal requirements, in accordance with the Italian Privacy Code (Legislative Decree 196/2003) and the EU Regulation 2016/679 (GDPR).
2. The Customer may request access to these documents by written request sent to MF Design S.r.l. at least 7 business days in advance by registered letter. Copies (paper or digital) may be requested against payment of reproduction costs.
Personal Data Processing
The processing of the Customer’s personal data complies with Legislative Decree no. 196/2003 and EU Regulation 2016/679 (GDPR), and any applicable local laws.
Data may be transferred to third parties, including outside the EU, in accordance with international data transfer rules.

Applicable Law
These General Terms and the related sales contract are governed by Italian law, specifically Legislative Decree no. 70/2003 on electronic commerce and, for consumers, Legislative Decree no. 206/2005 (Consumer Code), without prejudice to any overriding provisions of the Customer’s country of residence.
